Policy pursuant to and due to the effects of the GDPR (Regulation EU 2016/679) relating to the protection of personal data processing.

In your capacity as "Data Subject", i.e. the person to whom the data subject to processing refers, we would like to inform you of the essential elements of the processing carried out.

Processing purposes
The collection and processing of personal data are carried out in order to:
  1. fulfil all the operations imposed by regulatory obligations;
  2. perform all the operations strictly connected with and instrumental to the start of contractual relationships, including the acquisition of information prior to conclusion of the Contract;
  3. manage relationships for administration and accounting activities, orders, shipments, invoicing, services and manage any disputes;
  4. and will be subjected to processing based on the principles of fairness, lawfulness, transparency and the protection of your privacy and your rights.

    Processing methods
    The processing of data for the purposes illustrated above takes place using both automated methods, on electronic or magnetic media, and non-automated methods, on paper, in compliance with the rules of confidentiality and security provided for by law, by the resulting regulations and by internal provisions.

    Place of processing
    The data is currently processed and stored at the business offices of the undersigned: MODAR SpA, via Raffaello Sanzio nr. 18 – 20825 Barlassina (MB)

    It is also processed, on behalf of the undersigned, by professionals and/or companies appointed to carry out technical, development, management and administrative-accounting activities at their respective offices.

    Consequences of any refusal to provide data
    In cases in which provision of the data is foreseen by a regulatory or contractual obligation, any refusal would not allow the Controller to execute or continue the Contract since this would constitute unlawful processing. In cases in which there is no legal obligation to provide data, refusal would not have the consequences mentioned above but would still prevent the execution of ancillary operations.

    Communication of data
    Without prejudice to communications made in compliance with legal obligations, the data relating to your legal person may be communicated in Italy and/or abroad to:

    Professionals and consultants, consultancy companies, factoring companies, banks, credit collection companies, credit insurance companies, commercial information companies, companies operating in the transport sector; public and private bodies, also as a result of inspections or audits such as, for example: Tax Authorities, Tax Police, Judicial Authorities, Italian Exchange Office, Labour Inspectorate, LHA, Social Security Agencies, ENASARCO, Chamber of Commerce, etc.; Parties who may access your data by law.

    Data retention periods
    The data provided will be retained in our archives according to the following parameters:
    For administration and accounting activities, orders, management of quotations and the entire process of production, support and maintenance, shipping, invoicing, services, management of any disputes: 10 years as established by law by the provisions of art. 2220 of the Italian Civil Code, without prejudice to any delayed payments of amounts due justifying an extension.

    Rights of data subjects
    With regard to such personal data, data subjects can exercise the rights provided for by the following articles: right to transparency (Articles 5 and 12), right to information (Articles 12, 13, 14), right of access to data (Article 15), right of rectification and integration (Article 16), right to be forgotten and deleted (Article 17), limitation of processing (Article 18), right to data portability (Article 20), right of objection to processing (Article 21).

    If any form of consent to processing requested by MODAR SpA has been signed, it should be noted that the Data Subject may revoke the same at any time, subject to the mandatory requirements of current legislation at the time of the revocation request, by contacting the Data Controller.
